Cluster Munition Ban Policy

Five-Year Review: State Party Mexico was among the first 30 ratifications that triggered the convention’s entry into force on 1 August 2010. It has participated in all the convention’s meetings. Mexico has served as the convention’s coordinator on cooperation and assistance and, since September 2013, has served as victim assistance coordinator. It has condemned new use of cluster munitions, including in Syria.

In its initial transparency report for the convention provided in 2011, Mexico confirmed it has never used, produced, transferred, or stockpiled cluster munitions.

Policy

The United Mexican States signed the Convention on Cluster Munitions on 3 December 2008 and ratified on 6 May 2009. It was among the first 30 ratifications that triggered the convention’s entry into force on 1 August 2010.

Mexico has declared that the Convention on Cluster Munitions is “the supreme law of the entire Union” in accordance with Article 133 of the Constitution of the United Mexican States.[1] It has informed the Monitor that international treaties that Mexico joins become “the supreme law of the land and supersedes federal law.”[2] In 2012, Mexico stated it was drafting legislation to classify the use of cluster munitions as a crime, but no new legislative initiative developments have been reported since then.[3]

Mexico provided its initial Article 7 transparency report on 27 January 2011 and has provided annual updated reports ever since, including on 29 April 2015.[4]

As a member of the core group of countries that guided the Oslo Process to its successful conclusion, Mexico played an active leadership role in securing the Convention on Cluster Munitions, including by hosting a regional meeting in Mexico City in April 2008.[5]

Mexico engages proactively in the work of the Convention on Cluster Munitions. It has attended every Meeting of States Parties of the convention, including the Fifth Meeting of States Parties in San Jose, Costa Rica in September 2014, where it made a general statement.[6] Mexico has participated in every intersessional meeting of the convention in Geneva, including those held in June 2015, where it made several statements. Mexico has participated in regional workshops on the convention, most recently in Santiago, Chile in December 2013.

Mexico has served as the convention’s co-chair on victim assistance since 2013, together with Afghanistan. In 2011–2013, it served as the convention’s co-coordinator on cooperation and assistance together with Spain.

At the UN General Assembly (UNGA) First Committee on Disarmament and International Security in October 2014, Mexico stated that it “condemns any use of [cluster munitions] by any actor, anywhere and under any circumstances” as “a violation of the principles of distinction and proportionality enshrined in international humanitarian law.”[7]

Mexico was one of the first states to express concern at Syria’s cluster munition use in October 2012.[8] In 2013, Mexico condemned Syria’s cluster munition use as “unacceptable.”[9] Mexico voted in favor of four Human Rights Council resolutions in 2014 and 2015 that condemned the use of cluster munitions in Syria, most recently on 2 July 2015.[10] Mexico has voted in favor of UNGA resolutions condemning the use of cluster munitions in Syria, most recently Resolution 69/189 on 18 December 2014, which expressed “outrage” at the continued use of cluster munitions.[11]

Interpretive issues

In March 2009, Mexico provided its views on the interpretation of several key provisions of the Convention on Cluster Munitions. Mexico believes that “both the transit and storage of cluster munitions is prohibited under any circumstances, unless these actions are performed for the purposes specifically stated in Article 3, paragraphs 6 and 7. This rule is also applicable in relations with States not Party to the Convention, as stated in Article 21.” It stated that “investment for the production of cluster munitions is also prohibited by the Convention.”[12]

Concerning Article 21 and the issue of interoperability, Mexico stated that “even when a State Party does not itself engage in prohibited activities during a joint military operation with States not Party to the Convention, deliberately providing assistance for the execution of prohibited activities is not allowed.”[13]

During the Oslo Process, Mexico opposed the retention of cluster munitions for training or research purposes.[14]

Mexico is a State Party to the Mine Ban Treaty. It is also party to the Convention on Conventional Weapons.

Use, production, transfer, and stockpiling

In its Article 7 reports, Mexico has declared that it “does not produce, store, possess, use or transfer cluster munitions.”[15]

Mexico has confirmed that it has not engaged in any of these activities in the past.[16]

Mine Ban Policy

Policy

The United Mexican States signed the Mine Ban Treaty on 3 December 1997 and ratified it on 9 June 1998, becoming a State Party on 1 March 1999. Mexico believes that existing legislation is sufficient to enforce the antipersonnel mine prohibition domestically.

Mexico previously served on the Standing Committee on Victim Assistance and Socio-Economic Reintegration (1999–2000), the Standing Committee on the General Status and Operation of the Convention (2002–2004), and the Standing Committee on the Enhancement of Cooperation and Assistance (2015–2016). Mexico has attended most meetings of the treaty, including the Third Review Conference in Maputo in June 2014, and more recently the Seventeenth Meeting of States Parties in Geneva in November 2018, where it provided a general statement.[1] At the intersessional Standing Committee meetings in June 2011, it was announced that Mexico joined the informal working group of Latin American countries that will monitor the implementation of the Cartagena Action Plan.

Mexico is party to the Convention on Conventional Weapons but not its Amended Protocol II on landmines or Protocol V on explosive remnants of war. Mexico is party to the Convention on Cluster Munitions.

Production, transfer, stockpile destruction, and retention

Mexico has never stockpiled, used, produced, exported, or imported antipersonnel mines, including for training purposes.

Mexico reported having discovered five unidentified antipersonnel mines in Tijuana, Miguel Alemán, and Ebanos in 2010. Two of these mines were destroyed by the end of that year.[2] In its Article 7 report submitted in 2018, Mexico reported the destruction of two Claymore M18A1 mines in April 2017. The origin of the mines is unclear.[3]
